O R D E R

There is a civil dispute between the petitioner and Sivakumar and Others. The suit in O.S.No.78 of 2020 is pending before the District Munsif Court, Gudiyatham. The subject matter of the suit is regarding the right and title over the temple, the present writ petition is filed seeking police protection to conduct festival in the said temple without impleading the rival claimants. Since the rival claimants not been arrayed as parties, the petitioner herein is permitted to file implead petition or withdraw this writ petition, to file a fresh writ petition arraying all the necessary parties.

2. Instead of impleading the necessary party, the present writ petition is filed with an intention to get an order behind their back. Hence, this writ petition is dismissed. No order as to costs. However, the dismissal of the writ petition will not stand in the way of the petitioner 2/4

herein to file a fresh writ petition for similar prayer impleading all the necessary parties. Consequently, the connected miscellaneous petition is closed.
