Defendant PRAYER: Plaint under Order IV, Rule 1 O.S.Rules R/W. or VII Rule 1 of Civil Procedure Code praying for a Judgment and Decree against the defendant (a)Directing the defendant to pay the plaintiff the sum of Rs.45,04,500/- (Rupees Forty Five Lakhs Four Thousand and five Hundred only) being the amount due on the promissory note dated 22.06.2006 (b) Directing the defendant to pay the interest on the principal amount of Rs.38,50,000/-(Rupees thirty eight lakhs and fifty thousand only) at the rate of 12% from the date of plaint till the date of realization (c) directing the defendant to pay the plaintiff the cost of the suit. JUDGMENT

It is submitted by the learned counsel for the Plaintiff that the matter has been settled out of Court between the parties amicably and the suit may be ordered to be dismissed as withdrawn. He has also made an endorsement to that effect.

2. Based on the submission made by the learned counsel for the Plaintiff and also in view of the endorsement made, this Civil Suit is dismissed as withdrawn and half of the Court fee is ordered to be refunded.
