C.M.P.No.15434 of 2023 in C.M.A.SR.No.71513 of 2023 SUNDER MOHAN,J.

This Petition has been filed seeking to condone the delay of 396 days in filing the above C.M.A.

2. This Court by order dated 10.08.2023 had directed the learned counsel for the petitioner to effect substituted service by way of paper publication. Today, the learned counsel produced the affidavit of service enforcing the paper publication in respect of R1. Though notice was served on the second respondent and name has also been printed in the cause list, none appeared on behalf of second respondent.

3. Heard the learned counsel appearing for the petitioner.

4. Considering the averments made in the affidavit filed in support of this petition and being satisfied with the same, the delay is condoned. Hence, this petition is ordered as prayed for.

5. Registry is directed to number the C.M.A., if it is otherwise in order and list the matter on 01.09.2023.
