PRAYER: Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus directing the respondents herein to fix the scale of pay of the petitioner in the post of Senior Superintendent (Draftsman) by granting Next Higher Scale of 13000-350-18250 (which is equivalent to the scale of pay of Manager, under FCS Scheme) from the existing scale of pay of 10750-300-16750 (which is the revised scale of pay of Assistant Manager) as per the Flexible Complementing Scheme (FCS) with effect from 01.01.1998, on which date the petitioner completed six years as per the FCS Scheme and thereby implement the order dated 19.12.2005 made in W.P.No.6660 of 2002 and consequently refix and revise the retirement and pensionary benefits and disburse all the accured arrears within a short date.

ORDER

It is noticed that the petitioner had died as early as on 14.04.2023 and the same has also been brought to the notice of this Court on 05.06.2023, where the learned counsel for the petitioner

had requested time to take out an application to take steps to bring his legal representatives on record. To date, no such application has been filed to bring his legal representatives on record. Therefore, this Writ Petition is dismissed as abated.
