O R D E R

The petitioner prays to call for the records in Cr.No.36 of 2014 on the file of the Inspector of Police, District Crime Branch (CALGSC), Vellore and quash the same.

2. The learned Additional Public Prosecutor would submit that after investigation, Charge Sheet has been filed on 13.12.2017 for the offences under Sections 120B, 420, 447, 468, 471, 294(b) and 506 (ii) IPC before the learned Judicial Magistrate, Thiruppur.

3. The learned counsel appearing for the second respondent / defacto complainant would submit that till date, the charge sheet has not been taken on file and the reasons have also not been assigned.

4. In view of the same, the learned Chief Judicial Magistrate, Vellore is directed to find out the reason, as to why the charge sheet which has been filed in the year 2017 is not taken on file. The learned Judge is also directed to take the Charge Sheet on file, in the manner known to law. Since the charge sheet is filed, nothing survives in the present Criminal Original Petition and no further adjudication is required and therefore, the Criminal Original Petition is dismissed.
