Criminal Original Petition filed under Section 482 of Criminal Procedure Code, to direct the first respondent herein to defreeze the Current Account of the petitioner herein bearing A/c No.0059-00135786-195001 maintained with the second respondent, Current Account bearing No.30315657820 and Savings Bank account bearing No.30837849904 both maintained with the third respondent herein.

ORDER

The petitioner is before this Court, with the prayer to direct the first respondent herein to defreeze the Current Account of the petitioner herein bearing A/c No.0059-00135786195001 maintained with the second respondent, Current Account bearing No.30315657820 and Savings Bank account bearing No.30837849904 both maintained with the third respondent herein.

2.The learned Additional Public Prosecutor would submit that the petitioner is arrayed as 1st accused, on the complaint lodged by the defacto complainant/4th respondent herein. The 1st respondent registered a case in Crime No.110 of 2019, for the offences under Sections 406, 409, 420, and 34 of IPC. In pursuant to the crime registered against the petitioner with the main allegation is that he had cheated the defacto complainant to the tune of Rs.65 Lakhs from him. In this regard, petitioner's current account has been freezed and now investigation is still in progress.

3.Considering the above submission, pending investigation in Crime No.110 of 2019, this Court is not inclined to defreeze the current account of the petitioner, which involved in major offence of Sections 406, 409, 420 and 34 of IPC. Hence the Criminal Original Petition is dismissed.
