Writ petition is filed under Article 226 of the Constitution of India praying to issue Writ of Mandamus, directing the first respondent herein to deseal the shop bearing Door No.3/420-A, Bagalur Road, Hosur Taluk, Krishnagiri District and pass orders.

ORDER

Mr.M. Shajakhan, Special Government Pleader takes notice for the respondents.

2. By consent of both parties, this writ petition is taken up for final disposal at the stage of admission itself.

3.When the writ petition was taken up for hearing, the counsel for the petitioner fairly submitted that no representation was submitted by the petitioner before filing the writ for mandamus. This Court expressed its view that in the absence of a representation, the writ for mandamus cannot been entertained because demand and refusal were sine qua non for issuance of the writ of Mandamus 2/4

4. The learned counsel for the petitioner therefore prayed that he may permitted to withdraw the writ petition with liberty to submit a representation to the first respondent and the DRO/Krishnagiri District. The counsel has also made an endorsement to that effect in the bundle.

5. The learned Special Government Pleader appearing for the respondents fairly submitted that he has no objection to the petitioner's request.

6. In view of the submission and the endorsement made by the learned counsel for the petitioner this writ petition is disposed of, with liberty as prayed for. However, there shall be no order as to costs. 04.06.2025 Index:Yes/No Speaking order:Yes/No 3/4
