The petitioner, who was arrested and remanded to judicial custody on 24.10.2021 in connection with CC.No.99 of 2022 on the file of II Additional Special Court for EC & NDPS Act cases, Chennai in Crime No.907 of 2021, registered for the alleged offences punishable under Section 8(c), 20(b)(ii)(C), 25 & 29(i) of NDPS Act, seeks bail.

2. Learned counsel appearing for the petitioner submitted that this is the second bail petition and the earlier petition was dismissed by this Court in Crl.OP.No.8390 of 2024 dated 17.04.2024. He further submitted that no contraband has been seized from the petitioner and the petitioner's name has been implicated based on the confession of the arrested accused. He further submitted that the petitioner is suffering incarceration for more than 600 days and he is ready to abide any stringent conditions that may be imposed by this Court. Hence, he prays for grant of bail to the petitioner.

Learned Government Advocate (Crl.Side) appearing for the respondent police raised objection for granting bail to the petitioner stating that there are totally six accused in this case and the petitioner is ranked as A5. drl accused was found in illegal possession of 47 kgs of ganja, based on the confession of the arrested accused/A3 and A4, this petitioner was arrested. Subsequently, the respondent police arrested the accused and seized the entire contraband from the accused persons. He further submitted that the petitioner has 12 previous cases was pending against him and the case is posted today for the cross examination of the Investigation Officer. He further submitted that the investigation has been completed and the charge sheet has also been filed.

4. Considering the grave nature of offence and also considering the facts and circumstances of the case and there is no change of circumstances in the case, this Court is not inclined to grant bail to the petitioner.

5. Accordingly, this Criminal Original Petition stands dismissed. However, the trial Court is directed to dispose the case as expeditiously as possible, within a period of three months from the date of receipt of a copy of this order.
