O R D E R
This criminal original petition has been filed to call for the records in
Crime No.6 of 2021 on the file of the Inspector of Police, W-20 All Women Police Station, Saidapet, Chennai 15 and to quash the same.
2. When the matter is taken up for hearing, the learned counsel for the petitioner and defacto complainant submitted that as per the direction of this Court on 12.08.2022 both the parties appeared before the Tamil Nadu Mediation and Conciliation Centre, High Court, Madras on 26.09.2022 and on the same day the parties have settled their issues by way of settlement agreement.
3. A report of the Tamil Nadu Mediation and Conciliation Centre, High Court, Madras dated 26.09.2022 has been enclosed with the bundle and the case is listed for passing of an order in terms of the settlement arrived at between the parties.
4. On perusal of the report of the Mediation dated 26.09.2022, it is found that the parties have settled their issues by way of settlement agreement and both parties and their respective counsel have signed in the settlement agreement. The terms of the agreement runs as follows:-
"6. The following settlement has been arrived at between the parties hereto A. 2nd respondent/defacto complainant given her consent and tendered her no objection to allow the quash petition in Crl.OP.No.18623 of 2022 to quash the First Information Report (FIR) in Crime No.06 of 2021 on the file of 1st respondent herein, Saidapet All Women Police Station (AWPS - W20), Chennai B. Petitioner agreed to withdraw/close the O.P.No.77 of 2022, filed by the petitioner before Hon'ble Family Judge, Cuddalore for restitution of Conjugal rights. Where the Marriage was already declared as Null and Void on 19.09.2022 by the learned IV Additional Family Judge, Chennai in HMOP.No.4580 of 2021".
5. In terms of settlement arrived at between the parties which is recorded under the settlement Agreement by the Tamil Nadu Mediation and Conciliation Centre, High Court, Madras, in its Report dated 26.09.2022, this criminal original petition is disposed of recording the settlement Agreement. The settlement Agreement and the report of the Mediation Centre shall form part of this order.
