Civil Services (Discipline and Appeal) Rules 1955 based on my Representation dated 25.05.2024 & 30.01.2025 and conducting the proceedings by affording of personal hearings of the parties within a time stipulated time framed by this Court.

ORDER

This writ petition has been filed seeking a direction to the respondents 1 and 6 to take appropriate departmental disciplinary action against the respondents 7 to 13 under the Tamil Nadu Police Subordinate Services (Disciplines and Appeal) Rules 1955 and to direct the 2nd respondent to take appropriate departmental disciplinary action against the respondents 14 and 15 under the Tamil Nadu Civil Services (Discipline and Appeal) Rules 1955 based on the petitioner's representation dated 25.05.2024 and 30.01.2025 and conduct the proceedings by affording a personal hearing to the parties within a time frame to be fixed by this Court.

The main grievance of the petitioner is that the respondents 16 to 26, along with their henchmen, are attempting to illegally grab his property and that despite several complaints filed against them, the respondents 7 to 15, with the intention of obtaining illegal gratification, colluded with the respondents 16 to 26 and did not initiate any action on the complaints filed by the petitioner in accordance with Law, thereby enabling the respondents 16 to 26 to escape from punishment. In this regard, the petitioner gave representations to the respondents 1 to 6 on 25.05.2024 and 30.01.2025 requesting them to take appropriate departmental disciplinary action against the said erring officials. However, no action has been taken to date. Hence, the petitioner is before this Court.

3. Heard the learned counsels on either side and perused the materials available on record.

4. Considering the facts and circumstances of the case, a mandamus is issued to the respondents 1, 2 and 6 to consider the petitioner's representations dated 25.05.2024 and 30.01.2025, after issuing notice to the

petitioner as well as the interested parties, affording them an opportunity of personal hearing and to pass orders thereon on merits and in accordance with law within a period of four months from the date of receipt of a copy of this order.
