Heard Ms.A.S.Bharathi, learned counsel appearing for the petitioner and Mr.P.R.Dhilip Kumar, learned Standing Counsel accepting notice on behalf of the respondents and with their consent, the writ petition is disposed of at the admission stage itself.
The petitioner is aggrieved by the location of a transformer in Door No.5/1, Trust Square Street, Ramalingapuram, Medavakkam Tank Road, Chennai 600 012. The petitioner would state that the transformer is located just behind the petitioner's house and there is likelihood of a fire accident and danger to the petitioner's property as well as to the lives of the petitioner and his family members. Learned Standing counsel appearing for the respondents would submit that the respondent/Board has erected the transformer based on the "load centre" and the Low Tension connection has already been energised and the High Tension connection is to be energised today. It is his further submission that all safeguards are being taken and will be taken to ensure that there is no danger to the residents of the area.
In any event, there is a representation pending before the authorities wherein the petitioner has stated that there are other places where the transformer could be located. Learned counsel for the petitioner, on instructions, submitted that the petitioner's house has been constructed strictly in accordance with the building plan and there are no violations and the rear set back is also as per the approved plan.
In the light of the above, without going into the merits of the petitioner's contention, there will be a direction to the 3rd respondent to consider and dispose of the petitioner's representation dated 03.11.2015 on merits and in accordance with law and pass orders within a period of two weeks from the date of receipt of a copy of this order.
The writ petition is disposed of with the above direction. No costs. Consequently, the connected miscellaneous petition is closed.
