Writ Petition filed under Article 226 of the Constitution of India praying for issuance of a writ of certiorarified mandamus calling for the records relating to the impugned proceedings dated 05.02.2014 (Signed on 12.02.2014) in PROC No.4543/IE4/10-2 issued by the first respondent to the petitioner and quash the same and consequently to direct the respondents to allot the Plot No.39 A SIDCO Industrial Estate Nagapattinam on receipt of land cost in the year 2007 value or fix the cost of the land under notional method.

O R D E R

The relief sought by the petitioner in this writ petition is to issue a certiorarified mandamus calling for the records relating to the proceedings in PROC No.4543/IE4/10-2 dated 05.02.2014 (Signed on 12.02.2014) issued by the first respondent, quash the same and consequently, direct the respondents to allot Plot No.39A SIDCO Industrial Estate, Nagapattinam, on receipt of land cost as per the value in the year 2007 or fix the cost of the land under notional method.

2. When the matter was taken up for consideration, the learned counsel for the petitioner submitted that during the https://hcservices.ecourts.gov.in/hcservices/

pendency of this writ petition, the Government has issued G.O.Ms.No.50 dated 11.10.2021 fixing the land cost of SIDCO Industrial Estate, Nagapattinam and the petitioner is ready and willing to pay the cost of the land, as per the said G.O. It is further submitted that when the petitioner approached the respondents and requested them to receive the land cost and execute a sale deed in his favour, he was informed that his file will be placed before the Board for consideration, subject to the condition that he should withdraw this writ petition. Therefore, the learned counsel sought permission of this Court to withdraw this writ petition. He has also sent a letter dated 02.05.2022 to the Registry as well as made an endorsement in the case bundle to that effect.

3. Considering the submissions coupled with an endorsement made by the petitioner's counsel, this writ petition is dismissed as withdrawn. No costs. Consequently, connected Miscellaneous Petition is closed.
