... Defendants PRAYER: Plaint under Order IV Rule 1 of O.S. Rules read with Order VII Rule 1 of CPC praying for the Judgment and Decree against the defendants (a) declaring that the action of the second defendant in issuing letter dated 17.10.2010, suspending the plaintiff as one of the joint Honourary Secretaries of the first defendant association, as ultravires the rules and regulations of the first defendant association, malafide

and motivated and hence null and void ab-initio and unenforceable;

(b) granting permanent injunction, restraining the defendants, their office bearers, executive committee members or any other persons acting under them from in any manner giving effect to the order dated 17.10.2010 passed by the second defendant;

(c) granting permanent injunction restraining the defendants their office bearers, executive committee members or any other persons acting under them from in any manner interfering with the plaintiff's right to function as Joint Honourary Secretary of the first defendant association till such time the General Body Elections of the first defendant association is held; (d) directing the defendants to jointly and severally pay to the plaintiff the cost of the suit.

JUDGMENT

Today, when the matter is taken up for hearing, the learned counsel for the plaintiff has sought permission of this Court to withdraw this suit. He has also made an endorsement to that effect.

2. In view of the submission made by the learned counsel for the plaintiff and also in view of the endorsement made, this Civil Suit is dismissed as withdrawn. No costs.
