Petition praying that in the circumstances stated therein the High Court will be pleased To modify the condition imposed in Crl.O.P.No.9892 of 2017 date 24/05/2017.
Order : This petition coming on for orders upon perusing the petition and upon hearing the arguments of M/S.T.MUTHUKRISHNAN, Advocate for the petitioner and of MR. J. KARUPPIAH, Advocate on behalf of the Respondent the court made the following order:- This petition is filed to modify the condition imposed on the petitioner in Crl.O.P.No.9892 of 2017 dated 24.05.2017.
2. When the petitioner/accused has been granted bail in respect of the offence under Sections 341, 294(b), 324, 506(ii) of IPC in Crime No.278 of 2017, this Court directed the petitioner to report before the respondent police daily at 10.30a.m for a period of four weeks and thereafter, as and when required for interrogation.
3. Now, the learned counsel appearing for the petitioner submits that the first accused has lodged a complaint against the respondent before various higher authorities, hence, the petitioner/second accused apprehends problems to appear before the respondent. Hence, he seeks for modification.
4. Considering the fact that, the allegation are levelled against the police official/ respondent, the condition imposed on the petitioner vide order dated 24.05.2017 made in Crl.O.P.No.9892 of 2017 is modified to the effect the petitioner shall appear before the Metropolitan Magistrate No.XVIII, Saidapet daily at 10.30 a.m. until further orders. The other conditions shall stand unaltered.
Time for execution of the bond is extended by two weeks from the date of receipt of a copy of this order.
