ORDER

(Order of the Court was made by S.M.SUBRAMANIAM,J.) The writ of mandamus has been instituted to direct the second respondent-Revenue Divisional Officer, Villupuram to issue community certificates to the petitioners pursuant to the report of the third respondent dated 29.06.2022.

2. The learned counsel for the petitioners would contend that the third respondent/Anthropologist has submitted a report in favour of the writ petitioners. Despite the report, no community certificate has been issued and therefore the petitioners are constrained to move the present writ proceedings.

3. The learned Additional Government Pleader for the respondents,

based on the status report filed by the second respondent, would submit that there are some disputed areas, which are all to be looked into by conducting a thorough enquiry. Therefore, the issuance of community certificate is to be considered only after completing the enquiry in all respects, since the petitioners seek Scheduled Tribe community certificate.

4. This Court is of the considered opinion that securing ST community certificate is for availing numerous benefits under the Government schemes, public employment, scholarship, etc. Therefore, such certificates are to be issued by conducting a thorough enquiry and after ascertaining the genunity of the community to which the applicant belongs. In the present case, enquiry is yet to be completed.

In view of the facts and circumstances, the respondents 1 & 2 are directed to conduct a thorough enquiry by following the due procedures and take a decision for issuance of community certificate to the petitioners, as expeditiously as possible. The learned counsel for petitioners would rely on the daily orders and observations made by this Court during the hearing of

the writ petition, which would confer no right to secure final orders from the hands of this Court. With this observation, the writ petition stands disposed of. Consequently, W.M.P.No.17014 of 2024 is closed. No costs. Index : yes/no (S.M.S.,J.) (K.R.S.,J.) 18.02.2025 ss To
