C.M.P.No.16159 of 2021 in C.R.P.No.1037 of 2015 G.K.ILANTHIRAIYAN,J.

This petition has been filed to grant further time for compliance of the said conditional order dated 15.07.2019 passed in the above CRP(NPD) No.1037 of 2015 and permit the petitioners to deposit the said sum of Rs.15,000/- to the credit of the above suit on such condition and terms as this Hon'ble Court may deem fit and proper in the circumstances of the case.

2. This Court by an order dated 15.07.2019, in CRP(NPD) No.1037 of 2015 directed the petitioners to deposit a sum of Rs.15,000/- as cost, while allowing the petition to set aside the exparte decree. The petitioners failed to comply with the said condition, due to Covid 19. There was delay in three years in payment of cost. However, the petitioners are ready and willing to pay additional cost as imposed by this Court.

3. Heard both sides.

4. Considering the facts and circumstances of the case, this petition is ordered and time is extended till 30.12.2022, on condition that the petitioners shall pay a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) directly to the respondent, failing which, the order passed by this Court in CRP(NPD) No.1037 of 2015 dated 15.07.2019, stands automatically cancelled.

5. On such payment by the petitioners, the Trial Court is directed to dispose of the suit, within a period of six months from the date of receipt of a copy of this order.
