ORDER
The learned counsel appearing for the petitioner has made the following endorsement:
"The subject matter has become infructuous in view of the Judgment rendered by the Hon'ble Supreme Court reported in 2015 (9) SCC 62 and the petitioner may be given liberty to make a representation to the respondents and the respondents may be directed to dispose of the same within a period of four weeks from https://hcservices.ecourts.gov.in/hcservices/
the date of receipt of a copy of the order in the light of the Judgment reported in 2015 (9) SCC 62."
2. The prayer to grant liberty to make a representation cannot be given by this Court is the objection raised by the other side.
3. Needless to point out that the Judgment of the Supreme Court is binding upon all the courts under Article 141 of the Constitution of India. When it is binding upon all the courts, certainly, it is binding upon the parties also. 3.1. Duty to act in terms of the Judgment is not a matter for direction from the Court and it is the duty emanating from the Judgment itself.
4. The Writ Petition is dismissed with the above observation. No costs. Consequently, connected miscellaneous petition is closed.
