praying to issue a writ of mandamus directing the 1st respondent to consider the petitioner's representation dated 20.02.2020 regarding allotment of lands measuring an extent of 71⁄2 cents in S.F.No.77/A in Kottur Village, Anaimalai Taluk by receiving valid sale consideration or to accede for the exchange of the petitioner's lands to the equivalent extent.

ORDER

[made by M.SUNDAR, J.] Adverting to earlier proceedings, Mr. T.K. Saravanan, learned Additional Government Pleader for R1 to R4, submitted that exchange plea of the writ petitioner (details of which have been captured in the earlier proceedings) continues to be under active consideration and that a decision will be taken by R2 (District Collector) as expeditiously as the official business of R2 would permit but in any event within a period of fourteen weeks from today i.e., on or before 06.11.2025. We record this submission of learned State Counsel as an undertaking given to this Court.

Be that as it may, Mr. C. Prakasam, learned counsel for R5 (private respondent), submits that while the private respondent is not completely opposed to exchange plea but the private respondent has certain submissions to make regarding the nature of the alternative land. In this regard, it is open to R5 to send a representation to R2 within two weeks from today i.e., on or before 14.08.2025. This representation of R5 shall also be taken into account by R2 and addressed (a decision one way or the other), while taking a decision on the exchange plea of the writ petitioner.

The order made by R2 shall be served on writ petitioner as well as R5 under due acknowledgment within seven working days from the date on which R2 makes the order.

Recording the stated position of the parties, captioned W.P. is disposed of albeit with the aforementioned directives, timelines and preservation of rights in the aforesaid manner. There shall be no order as to costs.
