ORDER
This Writ Petition is filed assailing the action of the respondent in placing the petitioner under suspension and also issuing him with a charge memo.
2. When the matter is taken up for hearing, the learned counsel appearing on behalf of the respondents submitted that the petitioner, being an employee of Electronics Corporation of India Limited, which is under the Ministry of Atomic Energy, if is aggrieved by the action of the respondents, has to approach the Central Administrative Tribunal and hence, the present writ petition is not maintainable before this court.
3. Learned counsel appearing on behalf of the respondents further submitted that the aforesaid issue has been gone into by this Court in the decision reported in CDJ Law Journal 2020 MHC 4558 [A.Maheswari Vs.
The Deputy Chief Executive (Admn.)] in W.P.(MD) No.SR 29869 of 2020 and has placed a copy of the aforesaid order before this Court.
4. On the aforesaid submission being made by the learned counsel appearing on behalf of the respondents, the counsel for the petitioner seeks permission of this court to withdraw the writ petition with liberty to approach the Central Administrative Tribunal to ventilate his grievance.
5. In view of the aforesaid submission and having regard to the decision of this Court in W.P.(MD) No.SR 29869 of 2020, the petitioner is permitted to withdraw the writ petition with liberty to approach the Central Administrative Tribunal. No costs.
6. Further, it is made clear that the time spent by the petitioner in pursuing the present writ petition before this Court from the date of filing the present writ petition till today, would stand excluded in terms of Section 14 of the Limitation Act.
