O R D E R

This Writ Petition has been filed seeking a direction to the 2nd respondent to pay arrears of annual lease amount for the years 2013 to 2021 to the petitioner by considering his representation dated 04.05.2021.

2.The brief facts of the case are that the 2nd respondent laid down five pipelines measuring 6 feet width over the petitioner's agricultural lands in the year 2012 and they paid the lease amount by way of cheques. In the mean while, the petitioner went abroad and from the year 2013 onwards, the 2nd respondent stopped paying annual lease amount to him. It is further stated by the petitioner that there is a severe leakage of oil in the pipeline laid down in the agricultural lands which https://hcservices.ecourts.gov.in/hcservices/

cause hindrance to the regular cultivation work. Hence, he submitted a representation dated 04.05.2021 to the respondents to pay the arrears of annual lease amount for the years from 2013 to till date. Finding no response on the same, the petitioner is before this Court with the present Writ Petition for the aforesaid relief.

3.Heard both sides and perused the materials placed before this court.

4.Considering the limited prayer sought in this Writ Petiton, this Court without going into the merits of the case, directs the respondents to consider the petitioner's representation dated 04.05.2021, if not considered earlier and pass appropriate orders on merits and in accordance with law, after affording an opportunity of hearing to the petitioner, within a period of eight weeks from the date of receipt of a copy of this order.

5.With the above direction, this Writ Petition is disposed of. No costs.
