Writ Petition filed under Article 226 of the Constitution of India, praying for issuance of a Writ of Mandamus directing the respondents 1 to 10 herein to forthwith initiate action to remove the encroachments made by the respondents 11 to 17 and reclaim the temple lands of an extent of 1.13 Acres along with well in Survey No. 100/11, 0.02 Cents in Survey No.100/12, 1.14 Acres in Survey No.101/10 and 0.48 Cents out of 1.45 Acres in Survey No.61/2, 0.03 cents out of 0.08 cents in Survey No.19/15 situated in Deviyakurichi Village and Lands of an extent of 0.45 cents in Survey No. 494/4, 0.89 cents in Survey No.494/6, situated in Manivizhundhan Village, Attur Taluk, Salem District, which belongs to Arulmigu Chidambareshwarar Temple and Ayyanappan Swamy Temple and Lands belonged to Chidambareshwarar Temple, Deviyakurichi village, and

ORDER

(The Order of the Court was made by K.KALYANASUNDARAM,J) Heard Mrs.AL.Gandhimathi, learned counsel for the petitioners, Mr.R.Siddharth, learned Government Advocate appearing for the respondents 2, 6, 7, 8 and 9, Mr.T.Chezhian, learned Additional Government Pleader appearing for the respondents 1, 3, 4, 5 and 10, Mr.M.Santhanaraman, learned counsel appearing for the 11th respondent, Mr.L.Rajasekar, learned counsel appearing for the 12th respondent, Mr.B.Kannadasan, learned counsel appearing for the 14th respondent, Mr.R.Nalliappan, learned counsel appearing for the 17th respondent and perused the materials available on record. 2.

The petitioners have come forward with this writ petition seeking for issuance of a Writ of Mandamus directing the respondents 1 to 10 herein to forthwith initiate action to remove the encroachments made by the respondents 11 to 17 in the land belonging to the Ayyanappan Swamy Temple and Arulmigu Chidambareshwarar Temple situated at Deviyakurichi village and Manivizhundhan village, Attur Taluk, Salem District. 3.

issued to the fourth respondent to act on the representation of the petitioners.

4.The learned counsels appearing for the respondents 11 to 17 would argue that there was no encroachment as alleged by the petitioners and this litigation has been filed due to private enmity.

5.The learned Additional Government Pleader Mr.T.Chezhian, on instructions, would state that encroachments in the land belonging to the temple was found by the officials and the fourth respondent is ready to take appropriate action on the representation of the petitioners.

6.In the light of the above submissions of the learned counsels and the limited scope of the prayer sought for in this writ petition, this Court without expressing any opinion on the merits of the matter, directs the fourth respondent to take appropriate action on the representation of the petitioner and pass appropriate orders in accordance with law, after affording ample opportunity to the necessary parties, within a period of six months from the date of receipt of a copy of this order. It is made clear that at the time of removal of encroachment, the Superintendent of Police, Salem District, the 9th respondent herein shall provide necessary assistance to the fourth respondent.

7.It is informed that part of the land belongs to the temple was sold and pursuant to the order passed in W.P.No.10095 of 2013, sale deeds came to be cancelled. It is informed that patta proceedings have been pending before the Revenue Authorities. Hence, they are hereby directed to conclude pending proceedings at the earliest preferrably within a period of three months.

8.With the above direction, this Writ Petition is disposed of. No costs.
