Petition praying that in the circumstances stated therein and in the affidavit filed therewith the High Court will be pleased to modify the condition stipulated in the enlarged Anticipatory Bail order dated 28.07.2021 passed by this Hon'ble Court in the above Crl.O.P.Nos.12616, 12655 & 12643/2021 pending investigation in Crime No.05/2021 on the file of the Respondent.

(Crl.M.P.Nos.10267, 8399 & 8400/2021 in Crl.O.P.Nos.12616, 12655 & 12643/2021) (i) To Modify the conditions that waive the deposit amount of Rs.4,20,000/- and permit the petitioner to execute the sureties made in Crl.O.P.No.12625 of 2021 dated 28.07.2021. (Crl.M.P.No.8401/2021 in Crl.O.P.No.12625) Order : This petition coming on for orders upon perusing the petition and the filed in support thereof and upon hearing the arguments of M/S.M.PALANIMUTHU, Advocate for the petitioner, (Crl.M.P.Nos.10267, 8399 & 8400/2021 in Crl.O.P.Nos.12616, 12655 & 12643/2021) and of M/S.C.PRABAKARAN, Advocate for the petitioner,

(Crl.M.P.No.8401/2021 in Crl.O.P.No.12625) and of MR.A.GOPINATH, Govt. Advocate (Crl. Side) on behalf of the Respondents, [IN ALL THE PETITIONS] the court made the following order:- These Criminal Miscellaneous Petitions have been filed seeking to modify the condition imposed by this Court in Para 7(a) of the order dated 28.07.2021 in Crl.O.P.Nos.12616, 12655, 12643 and 12625 of 2021.

2.The learned counsel for the petitioners submitted that totally there are 7 accused persons in which four accused persons have filed these petitions and three accused persons have filed different petitions. However, this Court had imposed the conditions on the petitioners to deposit the sum of Rs.4,20,000/- (Rupees Four Lakhs and Twenty Thousand only) being alleged total misappropriation funds. Hence he prays for suitable modification so as to enable the four accused persons herein, to pay their portion of the amounts, without prejudice to their rights and contentions when the matter is taken on trial.

3.Learned Government Advocate (Crl. Side) has no objection to granting the said modification.

4. Accordingly, the condition imposed in para 7(a) of the order dated 28.07.2021 shall stand modified to the effect that the each of the petitioner, without prejudice to his rights, shall deposit a sum of Rs.75,000/- (Rupees Seventy Five Thousand only), through demand draft drawn in favour of the District Collector, Perambalur. The other conditions imposed by this Court shall remain unaltered. 5.Accordingly, these Criminal Original Petitions are modified. -sd/- 29/09/2021 This order, on being produced, be punctually observed and carried into execution by all concerned TRUE COPY Sub-Assistant Registrar (Statistics/C.S.)
