Application No. 3346 of 2024 in C.S. No. 192 of 2023 C.V.KARTHIKEYAN, J.

This application has been filed seeking to condone the delay of filing the written statement filed on behalf of the second and third defendants seeking for declaration of joint 1/6th undivided share in the suit schedule mentioned property for partition and for separate possession.

2. In the affidavit filed in support of the application of judges summons, it had been stated that the applicants have been travelling frequently on account of their employment, and had to gather the particulars and secure other documents pertaining to the family of Sarojini Mudaliyar and her legal heirs and in that process, there is a delay of 204 days in filing the same.

3. Taking into consideration all the factors, the application stands allowed and delay is condoned.

4. Registry may taken on record the written statement filed on behalf of the D2 and D3.
