Prayer: Appeal Suit filed under Section 96 of CPC r/w Order 41, Rule 1 of CPC to set aside the Decree and Judgement dated 18.6.14 in O.S.No.86/09 on the file of the II Additional District Judge, Pondicherry and dismiss the suit. For Appellant : Mr.S.Vijayakumar For Respondent : Mr.T.P.Manoharan, Sr. Counsel for Mr.K.P.Jotheeswaran JUDGEMENT The learned counsel appearing on behalf of the appellant made a submission that the issues between the parties have already been settled out of Court. Even before hearing of the Appeal Suit, the issues were settled between the parties. Under these circumstances, the learned counsel for the appellant made an endorsement that the appellant may be permitted to withdraw the Appeal Suit and refund of Court fee may also be ordered. 2.

In view of the submission and the endorsement made, the Appeal Suit stands dismissed as withdrawn and the appellant is entitled for refund of Court fee and accordingly, the Registry is directed to refund the Court fee as per the provisions of the Court Fee Act. No costs. Consequently, connected miscellaneous petition is closed.
