When the matter came up for hearing on 23.08.2021, this Court expressed its mind and informed the learned counsel for the petitioner that the dispute involved in the present case can be tried only by a competent Civil Court. Learned counsel therefore sought for time to take instructions.

2. When the matter was taken up for hearing today, the learned counsel for the petitioner submitted that he will withdraw the writ petition and that liberty may be granted to enable the petitioner to move the appropriate Civil Court. Liberty is granted and it is left open to the petitioner to move the appropriate Civil Court to redress their remedy.
