Prayer: Writ Petition filed under Article 226 of the Constitution of India for issuance of a Writ of Mandamus, directing the first respondent to issue a formal gazette order for increase of intake to 100 students for two basic units of 50 students each in B.Ed course to the petitioner college from the academic year 2020-21 onwards as per the original order dated 05.05.2015 of the first respondent in compliance to the order passed by the Member Secretary, NCTE dated 18.02.2019 and consequently direct the second respondent University to permit the petitioner College to admit 100 students for two basic units of 50 students each in B.Ed course from the academic year 2020-21 onwards pending formal orders to be passed by the first respondent.

This writ petition has been filed to issue a Writ of mandamus directing the first respondent to issue a formal gazette order for increase of intake from 50 students to 100 students for two basic units in the B.Ed course conducted by the petitioner college from the Academic Year 2020-21. 2.Heard Mr.D.Prabhu Mukunth Arunkumar, learned counsel for the petitioner and Mr.Su.Srinivasan, learned standing counsel appearing on behalf of the first respondent.
3.It is seen from the records that the original order dated 05.05.2015, passed by the first respondent is said to have been restored and the learned counsel for the petitioner submitted that what remains is only a formal order to be passed by the first respondent.
4.Mr.Su.Srinivasan, learned standing counsel appearing for the first respondent submitted that due to the pandemic situation, the first respondent is not able to convene the meeting immediately to take a decision and therefore, requested this Court to give some time to enable the first respondent to pass orders on the request made by the petitioner institution. 5.Taking into consideration the facts and circumstances of the case and the specific stand that has been taken on either side, there shall be a direction to the first respondent to pass final orders, within a period of six weeks from the date of receipt of a copy of this order. The petitioner has already sent detailed communications in this regard on 26.09.2019 and 06.08.2020 and the same shall be considered along with all the other relevant documents at the time of passing of final order. 6.This writ petition is disposed of with the above direction.No costs.
