Respondents Prayer: Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus directing the first respondent to consider the petitioner's application in 2024/0123/08/002560 dated 24.05.2024 and lay the boundary stones each 20m distance in the petitioner's land situated in S.No.297/1C, Sathyanagar, Kaveripuram Village, Mettur Taluk, Salem District to an extent of 70 cents.

ORDER

This Writ Petition is filed to direct the first respondent to consider the application of the petitioner in 2024/0123/08/002560 dated 24.05.2024 and lay the boundary stones each 20m distance in the petitioner's land situated in S.No.297/1C, Sathyanagar, Kaveripuram Village, Mettur Taluk, Salem District to an extent of 70 cents.

Heard learned counsel for the petitioner and the learned Government Advocate appearing for the first respondent and the Additional Public Prosecutor appearing for the second respondent and perused the materials available on record. Despite service of notice and name printed in the cause list, none appeared for the third respondent.

4. The case of the petitioner is that he is the owner of the subject property to an extent of 70 cents S.No.297/1C in Sathyanagar, Kaveripuram 2/5

Village, Mettur Taluk and patta has also been issued in favour of the petitioner for the said property. The grievance of the petitioner is that though he has given an application to the first respondent to lay boundary stone by paying requisite fee, the same has not been considered till date. Hence, the present Writ Petition.

Considering the limited relief sought for in this writ petition, the first respondent is directed to consider the application of the petitioner dated 25.05.2024 and pass appropriate orders on the same, after giving notice to the neighbouring land owners and any other interested persons, within a period of two months from the date of receipt of a copy of this order.

6. With the above direction, this Writ Petition is disposed of. No costs.
