Prayer: Writ Petition is filed under Article 226 of Constitution of India, to issue a Writ of Mandamus, directing the first respondent to release the Mahindra Bolero 128 SC XL Vehicle bearing registration No.TN 37 BM 2158 seized by the 2nd respondent on 25.03.2023 and consequently thereby direct the 1st respondents to herein to consider the petitioner representation dated 15.05.2023.

ORDER

The petitioner's Mahindra Bolero 128 SC XL Vehicle bearing registration No.TN 37 BM 2158 was seized by the Authorities on the allegation of smuggling PDS rice. The petitioner requires the release of the said vehicle.

2.Mr.G.Ameedias, learned Government Advocate appeared on behalf of the respondents 1 and 2 and brought to the notice of the Court the proceedings of the District Revenue Officer dated 28.06.2023 asking the petitioner to show cause why the vehicle should not be confiscated under the provisions of the Essential Commodities Act. This Court was also informed that the petitioner's aforesaid vehicle was also involved in an identical case last year.

3.Inasmuch as an Statutory Authority has begun his proceedings under the stature, it is only appropriate that the petitioner appear and show cause to the notice that was served on him, if he is desirous. 2/4

4.For the present, this Court refrains from making any decision in the matter.
