This Civil Revision Petition has been filed to set aside the order and decretal order dated 09.09.2009 made in E.P.No.18 of 2008 in O.S.No.136 of 2003 on the file of the learned District Munsif cum Judicial Magistrate, Nannilam.

2. Today, when the matter came for hearing, both the learned counsel

for the petitioner and the respondent submitted that the possession of the property has already been handed over to the respondent and also produced a copy of the decree in execution proceedings in E.P.No.18 of 2008 in O.S.No.136 of 2003. As the possession of the suit property has already been handed over to the respondent, nothing survives in this petition.

3. In view of the submission made on either side, this Civil Revision Petition is dismissed as infructuous. No costs. Consequently, connected Miscellaneous Petition is closed.
