This application is filed seeking permission to amend the provision of law as Section 232 and 276 of Indian Succession Act read with Order XXV Rule 5 of O.S. Rules and para 11 and 12 of the Original Petition in O.P.No.605 of 2018 now TOS.No.4 of 2021 as mentioned in the Judges Summon.

2. The learned counsel for the applicant submitted that the proceedings was originally initiated for grant of probate of the Will dated 07.08.2002 and it has to be a petition for grant of Letters of Administration with Will annexed as provided under Form 59, Order XXV Rule 5 of O.S. Rules read with Section 232 and 276 of the Indian Succession Act read with Order XXV Rule 5 of the O.S. Rules. 1956.

3. The learned counsel for the respondents has no objection for allowing this application.

4. Considered the reasons stated in the affidavit and satisfied with the reasons and also fact that learned counsel for the respondents has no objection for allowing this application, this application is allowed. https://www.mhc.tn.gov.in/judis 1/2
