department on the light of judgment in W.P.No.33851/2018, dated 18.10.2023.

ORDER

This Writ Petition is filed for a direction to the respondents to consider the petitioner's representation, dated 20.11.2023 pending on the file of the respondents.

On a perusal of the said representation and the other records which are filed in the instant case, it is clear that the petitioner was earlier dismissed from service by the order, dated 12.01.2018. He preferred a departmental appeal and the same was dismissed on 28.03.2018. The petitioner challenged the same before this Court by way of W.P.No.20082 of 2018 and the same was dismissed by the detailed judgment, dated 14.06.2022.

3. Now, it is the contention of the petitioner that in several other cases, a similar ground raised by the petitioner has been considered 2/5

positively. On that basis, the petitioner has made the representation. When a judgment is there between the petitioner and the respondents, the petitioner cannot request the respondents to dispose of the representation on the basis of the judgment which is given in respect of the third parties. The only remedy available to the petitioner would be to move the same Court by way of a Review Petition and unless the said judgment is varied or modified, the prayer of the petitioner cannot be acceded to by this Court.

4. With the above observations, this Writ Petition is disposed of. There shall be no order as to costs.
