(Order of the Court made by M.DURAISWAMY,J.) The petitioner has filed the above Writ Petition to issue a Writ of certiorarified mandamus to call for the records of the impugned Auction Sale Notice of the 2nd respondent dated 06.02.2014 and to quash the same as illegal and further direct the 2nd respondent against taking any action affecting the secondary charge of the petitioner on the schedule mentioned property.
2.When the matter is taken up for hearing, the learned counsel for the petitioner submitted that since no auction was conducted pursuant to the sale notice dated 06.02.2014, the Writ Petition has become infructuous.
3.In view of the submission made by the learned counsel for the petitioner, the Writ Petition is dismissed as infructuous. No costs. Consequently, the connected miscellaneous petitions are closed.
