This Application has been taken out at the instance of the Applicant/8th defendant to set aside the exparte order dated 12.03.2024 made in C.S. No.763 of 2013, against the applicant herein and permit the applicant to contest the suit on merits and in accordance with law.
2. I find from the affidavit that the 8th defendant has been served only with private notice. The learned counsel for the respondents has no serious objections to set aside the exparte order against the 8th defendant.
3. I find from the records that an opportunity is to be granted to the 8th defendant to contest the suit. In any event, the suit is pending and therefore, no prejudice would be caused to the plaintiffs, if the exparte order against the 8th defendant being set aside. Accordingly, this Application is allowed.
