O R D E R

This writ petition has been filed for the issue of a writ of Mandamus directing the third respondent to act upon the representation made by the petitioner on 15.10.2019 wherein the petitioner has sought for pattta with respect to the subject property.

2. The case of the petitioner is that he filed a suit in O.S.No.83 of 2006 before the Sub Court, Arani against one Arunachalam for recovery of money based on a mortgage. The further case of the petitioner is that this suit was decreed and the preliminary decree was passed on 07.12.2006 and final decree was passed on 06.11.2007.

3. The property was thereafter brought for sale and the sale certificate was also executed by the Sub Court, Arani on 03.12.2015.

4. The petitioner made a representation to the third respondent seeking for patta. Since the same was not acted upon, the present writ petition has been filed before this Court for appropriate directions.

5. Heard Mr.B.Jawahar, learned counsel for the petitioner and Mr.Annai Ezhil, learned Government Advocate appearing on behalf of the respondents 1 to 3.

6. Taking into consideration the facts and circumstances of the case and the limited relief sought for in this writ petition, there shall be a direction to the third respondent to consider the representation made by the petitioner dated 15.10.2019 and pass orders strictly in accordance with law, within a period of six weeks from the date of receipt of a copy of this order. If the third respondent finds that there is any other interested party who will have to be heard before final orders are passed, notice shall be given to the concerned party and the party shall also be heard before final orders are passed.

7. The petitioner is directed to make a fresh representation to the third respondent along with all the relevant documents and also a copy of this order.

8. This writ petition is disposed of with the above directions. No costs.
