The petitioner, who was arrested and remanded to judicial custody on 03.04.2022 for the alleged offences punishable under Sections 366, 342, 354-A, 294(b), 506(i) IPC and under Section 4 read with Section 18 of the Protection of Child from Sexual Offences [POCSO] Act, 2012 altered under Sections 366, 342, 354-A, 294(b), 506(ii) IPC and under Section 4 read with Section 18 of POCSO Act, 2012 and under Section 4 of the Tamil Nadu Prevention of Women Harassment Act, 2002, in Crime No.08 of 2022 on the file of the respondent/Police, seeks bail.

2.The case of the prosecution is that the de-facto Complainant is the mother of the victim minor child, aged about 31⁄2 years. The petitioner/accused who is aged about 57 years, had sexually abused the victim girl. Hence the complaint.

3.The learned counsel appearing for the petitioner/accused submitted that the petitioner has not committed any offence as alleged by the prosecution and he has been falsely implicated in this case. She further submitted that charge sheet has also been filed. Hence, she prays for grant of bail to the

petitioner.

4.The learned Government Advocate (Criminal Side) appearing for the respondent/State vehemently opposed for grant of bail to the petitioner, as the victim minor child is only aged about 3 1⁄2 years. He further submitted that charge sheet has also been filed.

5.Considering the gravity of the offence committed by the petitioner/accused and also taking into consideration the age of the victim girl, this Court is not inclined to grant bail to the petitioner. 6.This Criminal Original Petition stands dismissed accordingly. 20.07.2022 msm
