Writ Petition filed under Article 226 of the Constitution of India to issue a Writ of Certiorarified Mandamus to call for the records relating to the impugned notice No.Z.08/C.No./049/2020 dated 09.10.2020 affixed at the outer door of the petitioner premises on 24.07.2021 under sections 56 and 57 read with Section 85 of the Town and Country Planning Act and issued by the respondents 3 to 5 herein and quash the same and consequently issue appropriate directions forbearing the respondents herein and their subordinates, not to proceed with Lock and Seal of the petitioner premises in Door No.2, M.T.H.Road, Ramakrishnapuram, Villivakkam, Chennai - 600 092.

When the matter came up for hearing on 06.11.2023, learned counsel for the petitioner submitted that he had given change of Vakalat to the petitioner in the year 2021 itself and therefore, Registry was directed to print the name of the petitioner in the cause list. Today, the name of the petitioner is printed in the cause list and when the matter is called, there is no Page 2/4

representation for the petitioner either in person or through counsel. Therefore, this Court has no other option except to dismiss the writ petition for non-prosecution. Accordingly, the Writ Petition is dismissed for nonprosecution. No costs. Consequently, connected miscellaneous petition is closed.
