The petitioners, who were arrested and remanded to judicial custody on 14.06.2022 for the offences punishable under Section 307 of IPC in crime No.142 of 2022 on the file of the respondent police, seeks bail.

2. The case of the prosecution is that, on 10.06.2022. the petitioners in a drunked mood waylaid and attacked the defacto complainant using beer bootle. Thereby, the defacto complainant sustained grievous injuries. Hence, the case.

3. The learned counsel for the petitioners would submit that the petitioners are innocent persons and they have been falsely implicated in this case. That apart, the petitioners have been suffering incarceration from 14.06.2022. Hence, he seeks for grant of bail to the petitioners.

4. The learned Additional Public Prosecutor would submit that the injured victim is still in hospital. Hence, he vehemently opposed to grant bail to the petitioners.

5. Considering the gravity of the offence committed by the petitioners, which is serious and heinous in nature, and also considering that the injured victim has not been discharged from the hospital, this Court is not inclined to grant bail to the petitioners at this stage.

6. Accordingly, the criminal original petition is dismissed. 11.07.2022 Sma
