The petitioner, who was arrested and remanded to judicial custody on 13.01.2022 by the respondent police for the offences punishable under Sections 376(3) of IPC r/w 3(a), r/w 4(2), 5(l) r/w 6 of Protection of Children from Sexual Offences Act in Crime No.03 of 2022, seeks bail.

2. The case of the prosecution is that, on the pretext of relationship, the petitioner had taken the victim girl to a secluded place and committed sexual assault of penetration on the victim girl. Hence, the complaint.

3. On perusal of the statement of the victim girl recorded under Section 164 of Cr.P.C., it reveals that the victim girl is aged about 16 years. The petitioner is already a married man gave birth to two children. While being so, he compelled the victim to love him and also on the pretext of false marriage committed penetrative sexual assault on the victim girl on compulsion. He also threatened her that if she refused for physical relationship 1/3

he will disclose it to all.

4. Therefore, the petitioner has committed very serious and heinous offence as against the minor victim girl and this Court is not inclined to grant bail to the petitioner.

5. Accordingly, this Criminal Original Petition is dismissed. 15.07.2022 mpl 2/3
