Respondents Prayer:- Writ Petition filed under Article 226 of Constitution of India for the issuance of Writ of Mandamus, permitting the petitioner to place idol of Irichi Ammal under a shed in the place where the Soolam is now placed in S.No.110N/4 Hec.0.08.5 in Kotlambakkam Village, Panruti Taluk, Cuddalore District, by considering the petitioner's representation dated 15.05.2024.

ORDER

This Writ Petition has been filed for a direction directing the respondents to permit the petitioner to place the idol of Irichi Amman under a shed in the place where the Soolam is now placed in S.No.110N/4, admeasuring 0.08.5 hectares, situated at Kotlambakkam Village, Panruti Taluk, Cuddalore District.

2. Heard the learned counsel appearing on either side and perused the materials available on record.

3. The petitioner is a native of Kotlambakkam Village, Panruti Taluk, Cuddalore District and he owned patta land adjacent to the subject property, viz., Survey No.110N/4 admeasuring 0.08.50 hectares. Admittedly, it is classified as poramboke land. Now, the petitioner seeks permission to install the idol called Irichi Amman in the subject property by putting up a terrace shed. In fact, already when the petitioner intended to put up some construction, the villagers, viz., the relatives of the petitioner, objected the same, for which, the petitioner also lodged a complaint. The construction of temple in the poramboke land cannot be entertained at any point of time. It would lead to construction

of a big temple. Now, this kind of activities are growing like mushroom, in order to earn money in a short cut method. Therefore, the petitioner should not be permitted to construct any temple in poramboke land. If at all he has any belief in the deity as his family God, he can very well construct a temple in his patta land. Therefore, the representation submitted by the petitioner cannot be considered and the writ petition is devoid of merits and is liable to be dismissed.

4. Accordingly, this writ petition stands dismissed. No costs.
