O R D E R

This Writ Petition has been filed by the petitioner to direct the respondents 1 & 2 herein to dispose of the petitioner's representation dated 07.04.2025 and consequently direct the respondents 1 & 2 to provide police protection to the petitioner herein while taking his machineries inside his company viz., M/s.Jayaraj Yarns India Pvt Ltd., situated at D.No.1/255, Koonavelampatti Village, Namakkal.

2. The learned counsel for the petitioner submitted that the petitioner's family had started a Spinning Mill in the name and style of M/s.Jayaraj Yarns India Pvt. Ltd and invested their hard earned money for purchasing machineries for the said Spinning Mill. After the demise of the petitioner's father and grandfather, the mother and grandmother of the petitioner were managing the concern. During Covid-19, due to financial loss, the petitioner was compelled to close the said Mill. Thereafter, in order to overcome the financial loss, when the petitioner intended to sell the machineries kept inside the Mill, the third respondent along with his brothers attacked the petitioner with hands and legs and also threatened him with dire consequences. Further, they damaged the

CCTV Camera fixed in front of the said Mill. Hence, based on the complainant given by the petitioner, the FIR in Crime No 249 of 2024 has been registered against the third respondent and others. Now the present petition is filed seeking police protection to the petitioner herein while taking his machineries from his Mill.

3. Heard the learned counsel for the petitioner and the learned Government Advocate (Crl. Side) appearing for the respondents 1 and 2 and perused the materials available on record.

4. A perusal of records shows that there is a landlord and tenant dispute between the petitioner and the third respondent. Therefore, this Court is not inclined to give any direction to the respondents police as sought for by the petitioner by entertaining this Writ Petition.

5. Accordingly, this Writ Petition is dismissed.

6. However, the petitioner is at liberty to wok out his remedy in the manner known to law before the competent Court. 11.06.2025 ksa-2 Index:Yes/No Speaking Order: Yes/No
