ORDER
The petitioners, who were arrested and remanded to judicial custody on 09.11.2025 for the alleged offence under Sections 8(c) r/w 20(b)(ii)( C) and 29(1) of NDPS Act, 1985 in Crime No.175 of 2025 on the file of the respondent police, seeks bail.
2. The case of the prosecution is that the petitioner along with other accused were found in possession of 20 kgs of ganja. Hence, this case.
3. The learned counsel appearing for the petitioners submitted that the petitioner was in possession of 14 kgs of ganja which is an intermediate quantity. He also submitted that the petitioner is ready to abide by any stringent conditions that may be imposed by this Court. He further submitted that the matter was taken cognizance before the Trial Court. Hence, he prays to grant bail to the petitioner.
4. The learned Counsel for Government of Tamil Nadu (Crl Side) would submit that the total quantity involved in this case is 34 kgs of Ganja which is a commercial quantity. He further submitted that final report was filed and the case was taken on file before the Trial Court. He further submitted that this is the second bail petition and the earlier bail petition filed by the petitioner in Crl.O.P.No.1959 of 2026 was dismissed by this Court on 25.03.2026. Hence, he opposed for grant of bail to the petitioner.
5. Heard both sides and perused the materials available on record.
6. Even though the case is taken cognizance before the Trial Court, considering the facts of the case and nature of offence and the quantity involved in this case is commercial in nature and the petitioner failed to satisfy twin conditions under section 37 of NDPS Act and this is the second bail petition and the earlier bail petition filed by the petitioner in Crl.O.P.No.1959 of 2026 was dismissed by this Court on 25.03.2026, this Court is not inclined to grant bail to the petitioner and this Criminal Original Petition stands dismissed.
