the Constitution of India praying to issue a Writ of Certiorarified Mandamus calling for the records pertaining to ADM No.330/E4/2012 dated 27.07.2012 issued by the 3rd respondent and quash the same and direct the 3rd respondent to fix the petitioner scale of pay at Rs.9300-34,800 + grade pay Rs.4400/- as per the revised fixation statement in Appendix IV submitted by the 4th respondent.

"17.Thus, any of the petitioners are 2/5

aggrieved on account of the fact that their juniors are getting more pay, then they are liberty to approach the competent authority for the purpose of enhancement of their pay on par with their juniors.

19. It is made clear that if any of the petitioners are already retired from service and is a pensioner, then, recovery cannot be imposed from their pension or pensionary benefits.".

There shall be no order as to costs. Consequently, connected miscellaneous petitions are closed.
