ORDER

The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 4(1)(a), 4(1)(h), 4(1)(A) and 4(1)(C) of TNP (Amendment) Act in Crime No.787 of 2025, on the file of the respondent Police, seeks anticipatory bail. The earlier anticipatory bail petition of the petitioner in Crl.O.P.No.5396 of 2025 was dismissed by this Court, vide order dated 18.03.2025.

The case of the prosecution is that, based on a secret information, the respondent police found that A1 was in possession of 20 numbers of Brandy Pouch and 35 numbers of brandy bottles and based on his confession, it is revealed that the petitioner was also involved in the said offence. Hence, this case.

The learned counsel appearing for the petitioner submitted that the petitioner was falsely implicated in this case based on the confession of A1 and there is no recovery from the petitioner and sought for anticipatory bail to the petitioner. He also submitted that this is the fourth anticipatory bail petition of the petitioner.

The learned Government Advocate (Criminal Side) appearing for the respondent while opposing the anticipatory bail to the petitioner, reiterated the prosecution case and states that the petitioner has nine previous cases of similar nature; and that the investigation is pending. 5.

Considering the facts, nature of allegation, the previous antecedents of the petitioner and there is no change of circumstances after the dismissal of the earlier anticipatory bail petition in Crl.O.P.No.5396 of 2025, this Court is not inclined to grant anticipatory bail to the petitioner. 6.

Accordingly, this criminal original petition stands dismissed. 22.09.2025 stn 3/4
