Hence, the appellant wanted to withdraw the above Second Appeal and prayed to dismiss the same as withdrawn. Accordingly, the matter is listed today under the caption "for withdrawal".

2. When the matter taken up today for hearing, a similar submission is made before this Court and to that effect, an endorsement was also made. Memo is recorded.
