District Court) Poonamallee, till the disposal of the above appeal CMA No. 1637 of 2016 (in CMP.166/2018) pending disposal of this CMA.

1637/2018 Order : This petition coming on for orders upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of M/S.K.VARADHA KAMARAJ, Advocate for the petitioner and of MR.D.BHASKARAN, Advocate for the Respondent the court made the following order:- This Petition has been filed to permit the petitioners to withdraw the entire deposited amount Rs.13,87,936/- deposited to the credit of M.C.O.P.No.804 of 2012 on the file of Motor Accident Claims Tribunal/III Additional District Court, Poonamalle.

2. Heard both sides.

3. It is submitted by the learned counsel for the respondent/ Insurance company that already 50% of the award amount has been deposited to the credit of M.C.O.P.No.804 of 2012 on the file of Motor Accident Claims Tribunal/III Additional District Court, Poonamalle.

4. Considering the facts and circumstances of the case, the petitioners are permitted to withdraw 75% each of deposited amount already deposited to the credit of M.C.O.P.No.804 of 2012 on the file of Motor Accident Claims Tribunal/III Additional District Court, Poonamalle.

5. In view of the above, the petition is disposed of. -sd/- 24/01/2018 / TRUE COPY / Sub-Assistant Registrar ( Statistics / C.S. ) High Court, Madras - 600 104.
