ORDER

The petitioner, who was arrested and remanded to judicial custody on 08.02.2026 for the offences punishable under Sections 5(1), 5(j(ii) and 6(1) of POCSO Act, in Crime No.73 of 2025 on the file of respondent police. 2.The allegation against the petitioner is that the de-facto complainant who is the Child Help Line coordinator received an information that the victim minor girl who is a native place of Tiruvannamalai District. While she was in her native place one Dinesh who is none other than the relative to the victim minor girl gave a false promise and made her to fall on love. Thereafter, he committed sexual intercourse and now, she pregnant. The said incident took place at Tiruvannamalai District.

However, while the victim minor girl was in Chengalpattu, the occurrence was narrated before the de-facto complainant by the victim minor girl. Since the minor girl's mother has been refused to lodge the complaint, the complaint was lodged by the Coordinator of the Child Help Line. The respondent police registered a case against the petitioner and he was arrested and released on bail on 08.02.2026.

The learned Counsel for the petitioner submitted that the petitioner is an innocent person, he has been falsely implicated in this case and the petitioner has not committed any offences as alleged by the prosecution. He further submitted that the petitioner was arrested and remanded to judicial custody on 08.02.2026. He further submitted that the petitioner is ready to co-operate with the investigation/trial process. Hence, he prayed for grant of bail to the petitioner.

Mr.V.J.Priyadarsana, learned Government Advocate (Criminal Side) appearing for the respondent police, reiterated the prosecution case and submitted that 164 statement of the victim minor girl has recorded and the DNA test of the petitioner also matching with the new born child. He further submitted that if bail is granted to the petitioner, the petitioner would tamper the witnesses and may be absconded. Therefore, he strongly opposed to grant bail to the petitioner.

5.Considering both side submissions made by the learned Counsel on either side; that the gravity of offence committed by the petitioner; that 164 statement of the victim minor girl has recorded and the DNA test of the petitioner also matching with the new born child; if bail is granted to the petitioner, he would tamper the witnesses and to evade trial proceedings, this Court is not inclined to grant bail to the petitioner.
