Prayer: Criminal Original Petition filed under Section 482 of Cr.P.C. praying to direct the Principal District and Sessions Judge, Ooty (Special Judge for SC/ST Act Cases), to consider the petitioners' bail application to be filed on the same day on their surrender in Crime No.25 of 2020 pending on the file of the respondent.

ORDER

This Criminal Original Petition has been laid by the petitioners seeking direction to the Principal District and Sessions Judge, Ooty (Special Judge for SC/ST Act Cases), to consider the bail application of the petitioners on the same date of surrender pertaining to the Crime No.25 of 2020 on the file of the Cherambadi Police Station, Nilgiris District.

2. The petitioners are arrayed as accused in crime No.25 of 2020 for the offences punishable under Section Girl Missing @ Sections 9,10 and 11 of Child Marriage Act, 2006 r/w Section 3 (2)(va) SC/ST (POA) Amendment Act, 2015 and 5(1), 6 of POCSO Act 2012. falsely foisted against them and they have not committed the offences put forth against them and hence they are necessitated to seek necessary directions.

3. Considering the facts and circumstances of the case and in the interest of justice, I deem it fit to issue the following directions.

(i) The petitioners shall surrender before the Principal District and Sessions Judge, Ooty (Special Judge for SC/ST Act Cases), within 10 days from the date of receipt of copy of this order.

(ii) On the petitioners surrendering before the Principal District and Sessions Judge, Ooty (Special Judge for SC/ST Act Cases) and filing the bail application, the Principal District and Sessions Judge, Ooty (Special Judge for SC/ST Act Cases), is directed to consider and dispose of the bail application as expeditiously as possible, preferably on the date of surrender in accordance with law.

4. Accordingly, the Criminal Original Petition is disposed of.
