Tr.G.Chandrasekaran v. State Rep.By
Crl.M.P.No.7340 of 2017 in N.SATHISH KUMAR, J.
This petition has been filed by the petitioner seeking suspension of his sentence of imprisonment.
2. The petitioner faced trial in Spl. Case No.04 of 2009 on the file of the Special Judge, Chief Judicial Magistrate, Cuddalore and the trial Court, by a judgment dated 24.05.2017, convicted the petitioner under sections 7 and 13(1)(d) r/w.13(2) of Prevention of Anti Corruption Act 1998 and sentenced him to undergo rigorous imprisonment for one year and to pay a fine of Rs.1000/- with default sentence of three months each under section 7 and 13(1)(d) r/w.13(2) of Prevention of Anti Corruption Act 1998.
3. Challenging the same, the present appeal has been filed along with this petition for suspension of sentence.
6. Taking into consideration of the submission of the learned counsels appearing on both sides, since there are some arguable points available in the appeal, I am inclined to suspend the substantive sentence of imprisonment alone.
N.SATHISH KUMAR, J., vrc
7. Accordingly, pending appeal, substantive sentence of imprisonment alone is suspended and the petitioner is released on bail on his executing a bond for a sum of Rs.10,000/- (Rupees ten thousand only) with two sureties each for a like sum to the satisfaction of the Special Judge, Chief Judicial Magistrate, Cuddalore with further condition that he shall appear before the said court on the first working day of every month at 10.30 a.m., until further orders.
