ORDER
This writ petition has been filed seeking for a direction to the respondents to accept the surrender application dated 21.03.2026 returned by the 2nd respondent by considering the petitioner's application.

It is stated that the petitioner was granted a Mini Bus permit by the 1st respondent for operating the service on the route Sulur Perumalkoil to Pappampatti in Coimbatore District with effect from 17.07.2025. It is further stated that another operator was also granted a permit on the same route. Subsequently, the route was identified and surveyed by the department and the petitioner had no role either in the identification or survey of the route. It is the case of the petitioner that after commencing operations, she found that the route was not commercially viable and that the earnings were insufficient even to meet the operational expenses. Therefore, she submitted an application dated 21.03.2026 under Rule 204 of the Tamil Nadu Motor Vehicles Rules, 1989 seeking surrender of the permit. However, the said application was returned by the 2nd respondent. Hence this writ petition.
3. Learned counsel for the petitioner submitted that the returned application was not received by the petitioner and, therefore, he prayed that a 2/5
direction may be issued to the respondents to consider the surrender application of the petitioner and pass appropriate orders, within a time frame.
4. Per contra, learned Government Counsel appearing for the respondents submitted that the petitioner's application was returned pointing out certain defects. However, the petitioner has not re-submitted the application till date. He further submitted that if the petitioner re-submits the application, the same would be considered and appropriate orders would be passed in accordance with law, within a reasonable time.
5. Heard the learned counsel on both sides and perused the materials available on record.

In view of the aforesaid fair submissions, this Court directs the petitioner to re-submit the application for surrender of permit, after complying with the defects, within a period of one week from the date of receipt of a copy of this order. On such re-submission, the 1st respondent shall consider the same on its own merits and in accordance with law and pass appropriate orders within a period of four weeks thereafter.

7. With the above directions, the writ petition stands disposed of. No costs.
