This writ petition has been filed for a direction to the respondents to consider the petitioner's application dated 24.03.2026 for the transfer of permit of Minibus TN 39 DF 6989 operating on the route Tirupur Government Hospital to Kallampalayam.
2. It is stated that the petitioner is the holder of a Mini Bus permit to operate the service on the route Tirupur Government Hospital to Kallampalayam. Owing to her advanced age of about 75 years and the injuries sustained in an accidental fall during February 2026, she was unable to effectively manage the transport service. Due to her medical condition, she had submitted an application under Rule 208 of the Tamil Nadu Motor Vehicles Rules, 1989 read with Section 82(1) of the Motor Vehicles Act, 1988 seeking transfer of the permit in favour of her grandson. The said application was submitted on 24.03.2026. However, no orders have been passed, till date. Hence this writ petition.
3. Learned counsel for the petitioner submitted that it would suffice if a direction is issued to the respondents to consider the petitioner's application 2/5
dated 24.03.2026 seeking permission for transfer of permit from the petitioner's name to her grand son. Therefore, he prayed for issuance of suitable directions in the above regard.
4. Learned Government Counsel appearing for the respondents submitted that the petitioner's representation would be considered and appropriate orders would be passed in accordance with law within a stipulated time frame.
5. This Court has considered the submissions made by learned counsel on either side and perused the materials available on record.
6. In view of the limited relief now sought by the petitioner, without expressing any opinion on the merits of the case, directs the petitioner to submit a fresh representation along with this order copy to the 1st respondent, within a period of two weeks from the date of receipt of a copy of this order. On such submission, the 1st respondent shall consider the petitioner's claim and pass appropriate orders in accordance with law within a period of four weeks thereafter.
